Terms & Conditions

These Terms & Conditions ("Terms") govern your use of the Miles Apart service, including the iOS application and related services (together, the "Service"), operated by Miles Apart ("we", "us"). By creating an account or using the Service you agree to these Terms, our Terms of Use, and our Privacy Policy.

1. Eligibility

You must be at least 13 years old (or the higher minimum age required in your country) to use the Service, and at least 18, or have your parent or guardian's permission, to enter into these Terms. The Service is designed for two consenting partners; by pairing with another user you confirm they have agreed to connect with you.

2. Your account

You agree to provide accurate information, keep your credentials secure, and be responsible for activity under your account. Notify us promptly at support@ventnow.ai of any unauthorized use.

3. Pairing and shared content

Miles Apart is built around sharing with one linked partner. Content you create (photos, letters, drawings, game answers, streak activity, and, if enabled, your location) is shared with your paired partner as described in the App. You may disconnect from a partner at any time in Settings; shared history is preserved unless an account is deleted. Only share content you have the right to share and are comfortable with your partner keeping.

4. Acceptable use

You agree not to use the Service to:

• break the law or violate anyone's rights;
• harass, threaten, or intimidate any person, including a current or former partner;
• upload content that is unlawful, infringing, or that you do not have the right to share;
• pair with a person without their knowledge and consent, or track a person's location without consent;
• interfere with or disrupt the Service, probe its security, or access it by automated means.

We may remove content or suspend accounts that violate these Terms.

5. Subscriptions and purchases

• Optional paid features ("Miles Apart Pro") are offered as auto-renewing subscriptions or one-time purchases billed through your Apple ID.
• Subscriptions renew automatically unless cancelled at least 24 hours before the end of the current period. Manage or cancel in your App Store account settings; deleting the App does not cancel a subscription.
• Prices may change; changes apply to the next billing period after reasonable notice.
• Payments are processed by Apple, and refunds are handled by Apple under its policies. Consumable purchases (such as a streak restore) are delivered immediately and are non-refundable to the extent permitted by law.
• Statutory withdrawal rights for EU/UK consumers are honored as required by law.

6. Intellectual property

The Service, including its design, branding, and software, is owned by us or our licensors and protected by law. You retain your rights in the content you create, as described in the Terms of Use.

7. Termination

You can stop using the Service or delete your account at any time in the App. We may suspend or terminate your access if you materially breach these Terms, if required by law, or if we discontinue the Service, in which case we will give reasonable notice where possible.

8. Disclaimers

The Service is provided "as is" without warranties of any kind, express or implied, including fitness for a particular purpose and non-infringement. We do not guarantee the Service will be uninterrupted, error-free, or that content (including streaks, letters, or photos) will never be lost. The Service is not a substitute for professional relationship advice.

9. Limitation of liability

To the maximum extent permitted by law, we will not be liable for indirect, incidental, special, consequential, or punitive damages, or loss of data, arising from your use of the Service. Our total liability will not exceed the greater of the amounts you paid us in the twelve months before the claim or US $50. Nothing in these Terms limits liability that cannot be limited by law, including under EU consumer protection rules.

10. Indemnity

You will indemnify and hold us harmless from claims arising out of your content or your breach of these Terms, to the extent permitted by applicable law.

11. Governing law and disputes

These Terms are governed by the laws of the State of California, USA, without regard to conflict-of-law rules, and disputes will be resolved in the state or federal courts located in California. If you are a consumer in the EEA or UK, you also benefit from mandatory provisions of your local law and may bring proceedings in your country of residence.

12. Changes to these Terms

We may update these Terms from time to time. Material changes will be announced in the App or by email at least 14 days before they take effect; continued use after that constitutes acceptance. If you do not agree to changes, stop using the Service and delete your account.

13. Miscellaneous

If any provision of these Terms is found unenforceable, the remaining provisions remain in effect. These Terms, the Terms of Use, and the Privacy Policy are the entire agreement between you and us regarding the Service. Our failure to enforce a provision is not a waiver.
